HIRE TERMS & CONDITIONS

1. AGREEMENT (a) These Terms and Conditions (Hire Terms) along with the Hire Form (collectively, this Agreement) will apply to all the Customer's dealings with Big Marquee. (b) The Customer will be considered to have accepted this Agreement if the Customer accepts a Hire Form, or if the Customer orders, accepts, or pays for any goods and/or services provided by Big Marquee after receiving or becoming aware of this Agreement or these Hire Terms. (c) In case of any inconsistency between these Hire Terms and any Hire Form, the clauses of these Hire Terms will prevail to the extent of such inconsistency, except that any Special Conditions listed in the Hire Form will prevail over these Hire Terms to the extent of any inconsistency.

2. HIRE GOODS AND SERVICES (a) In consideration for the payment of the Fees, Big Marquee will provide the Customer with the Hire Goods to hire for use at the Site from the Start Time on the Start Date until the End Time on the End Date. (b) If applicable, in addition to the Hire Goods, Big Marquee will also provide the Services. (c) Unless otherwise agreed, Big Marquee may, in its discretion, not provide the Hire Goods and (if applicable) Services until the Customer has paid any Fees or deposit payable concerning such Hire Goods and Services.

3. TERM This Agreement will commence on the Start Date and continue until the Hire Goods have been returned in accordance with this Agreement and the Fees have been paid (Hire Period).
 

4. PRE HIRE The Customer must: (a) read or watch, understand and comply with any instructional materials provided by Big Marquee; (b) obtain up-to-date information about any underground utilities or structures at the Site (e.g., via "Dial Before You Dig"); (c) provide accurate and true information about the layout and condition of the Site; and (d) ensure that any person taking delivery of the Hire Goods on behalf of the Customer is authorised by the Customer to do so, and the Customer will not allege that any such person is not authorised.

5. HIRE GOODS 5.1 USING THE HIRE GOODS The Customer must: (a) only use the Hire Goods at the Site; (b) only use the Hire Goods following the Hire Goods manufacturer's and Big Marquee's instructions; (c) not damage, vandalise, modify, or otherwise alter the Hire Goods in any way; (d) oversee and supervise the Hire Goods at all times during the Hire Period; (e) not sub-hire the Hire Goods; and (f) only use the Hire Goods following all laws, rules, and regulations applicable to the Hire Goods and the Site.

6. FEES & PAYMENT (a) Hire Fee: $[Insert] Due Date: 7 days prior to the Start Date Security Deposit: $[Insert] (30% of the Hire Fee). The Security Deposit is generally non-refundable. Worker Fee: $45 per hour per worker engaged by Big Marquee. The Worker Fee is payable following clauses 6.3 and 6.4.
 

7. ENTIRE AGREEMENT These Hire Terms, any Hire Form, and any other document incorporated by reference, contain the entire understanding between the parties in relation to the subject matter of this Agreement.
